How long will it take to resolve my premises liability case?
Recently someone called me from South Carolina, and they wanted to know how long is it going to take for their case to settle when they had tripped over a trip hazard that wasn’t eliminated, that wasn’t guarded against, that wasn’t warned against. They had a serious surgery that left them with hardware in their foot. They wanted to know how long it was going to take.
In a case like this in South Carolina, you’re going to be blamed for not looking for where you were going. A lot of times there’s going to be a lot of resistance. Because of that resistance, you have to plan for the worst and hope for the best. When you plan for the worst, you have to prepare your case for trial in South Carolina.
You have to do that for two reasons; one, you have to show the insurance company that you’re not going to be ambushed in a trial. Two, you have to show the insurance company or the corporation that you’re not going to give away your power. To do that, you have to prepare for trial.
There’s a second factor as to why it can take some time on a case that is as serious as this case— it takes time for your body to heal. Your doctor makes judgments and gives you doctor’s orders with respect to what you can and cannot do. They also decide when you are as well as you’re going to be. Your doctor makes judgments about what future medical care you might have to have, including future surgeries. You don’t want to sell your case and find out later you’ve got to have a $50,000 surgery and your settlement isn’t enough to account for what you have to go through for that second surgery, much less to pay the medical bills after you spent some of your settlement money.
Your case is tied to how long it takes your body to heal and what your doctor thinks about what is prudent to do with your medical care. We know that this is a frustrating situation. However, if you’re the kind of person that wants to fight for your case and doesn’t want to give up or take a settlement that’s not really fair to you, call our office and we’ll help you fight these battles. We’ll help you prepare your case for trial, and we’ll help you work with your doctor and find out the information we need from your doctor so that we can prepare your case for trial.
