Is there a cap to my workers’ comp benefits?
Recently, I received a call from someone in Richmond County, NC who had been on workers’ comp for a while, and they wanted to know if there was a cap on the amount of benefits that they could receive in North Carolina. In North Carolina, there is a threshold cap, that is to say a cap where you have to cross over a certain line before you can get more benefits. In North Carolina, that line is 500 weeks. However, if your injuries are so severe that you can prove that you cannot work, even though you’re approaching the 500-week line, you may qualify for lifetime benefits. A lot of this depends on the medical evidence, as well as your education and the type of skills that you’ve acquired as you were working before you got hurt. It will also depend on how our courts interpret the law that imposed the cap after 2011 in North Carolina. If you feel like you have this type of situation or you’re just concerned about your case, feel free to contact us so that we can help you and assess your case. If you feel like you’re not going to be able to go back to work, but the company doctor that you’re having to treat with is going to tell you that you can anyway, that’s a red flag that you need an experienced North Carolina attorney in workers’ comp to assess your case. The sooner you get that attorney, the better you will be and the more time the attorney will have to do the work that’s necessary to protect your rights and protect your family.
